1. ACCEPTANCE Bonsaiforum provides the facility to publish online classified advertisements and anonymous email services ("the service") subject to the following Terms and Conditions ("T&C"). By using the services offered by BonsaiForum you are agree by default to comply with the T&C. BonsaiForum reserves the right, at our discretion, to cancel withdraw or amend any membership or advertisement placed by any member who fails to comply with the T&C We reserve the right to change, modify or otherwise alter these T&C at any time. You should review this agreement on a regular basis to ensure you are familiar with current conditions. 2. ADVERTISEMENT CONTENT You accept that all postings, messages, text, files, images, photos or other materials posted on, transmitted through, or linked from BonsaiForum are the sole responsibility of the person from whom such content originated. More specifically, you are entirely responsible for everything that you post, email or otherwise make available via BonsaiForum. You understand that BonsaiForum does not control, and is not responsible for content made available through any of the services offered and that by using the BonsaiForum you may be exposed to content that contravenes the T&C, in which case it is your responsibility to report such contraventions to BonsaiForum. Furthermore, BonsaiForum makes no representation or warranty as to the accuracy, completeness or authenticity of the information contained in any advertisements, emails or other postings on this site or any external site linked to via bonsaiForum or any of its services. Your linking to any other websites is at your own risk. You agree that you must assess and bear all risks associated with the content of any posting, advertisement, email or other communication on or via services offered by BonsaiForum. Under no circumstances will BonsaiForum be liable in any way for any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed or otherwise made available via the services offered by BonsaiForum. You acknowledge that BonsaiForum does not pre-screen or approve content, but that BonsaiForum shall have the right (but not the obligation) in its sole discretion to refuse, delete or move any content for violating the letter or spirit of the T&C or for any other reason. 3. THIRD PARTY CONTENT, SITES, AND SERVICES The content of postings on BonsaiForum may contain features and functions that may link you or provide you with access to third party content which is completely independent of and beyond the control of BonsaiForum, including web sites, directories, servers, networks, systems, information and databases, applications, software, programs, products or services, and the Internet as a whole. Your interactions with organizations and/or individuals found on or through BonsaiForum, including payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such organizations and/or individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. You agree that BonsaiForum shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings. In the event that you have a dispute with one or more other users of BonsaiForum, or any external website, you hereby release BonsaiForum, its officers, employees, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes. 4. NOTIFICATION OF CLAIMS OF INFRINGEMENT If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify BonsaiForum at abuse@bonsaiforum.com 5. YOUR RESPONSIBILITIES You agree not to post, email, or otherwise make available Content: a) that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way; b) that is pornographic or depicts a human being engaged in actual sexual conduct; c) that harasses, degrades, intimidates or is hateful toward an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; d) that impersonates any person or entity, including, but not limited to, a BonsaiForum management or employee, or falsely states or otherwise misrepresents your affiliation with another person or entity; e) that includes personal, contact or identifying information about another person without that person's explicit consent; f) that is false, deceptive, misleading, deceitful, misinformative. Advertisements known to infringe this requirement may be withdrawn by the management without warning; g) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party, or any other content that you do not have a right to publish without prior agreement of the owner of such patent, trademark, trade secret, copyright or other proprietary rights; i) that includes links to commercial services or external web sites, including coded or hidden website addresses or addresses written is such a manner as to avoid machine detection; j) that advertises any illegal service or the sale of any items the sale of which is prohibited or restricted by any applicable law, including without limitation items the sale of which is prohibited or regulated by law. It is your responsibility to ensure the legality of all services, products or items listed by you; k) that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of the content of your advertisement. Additionally, you agree not to: l) contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for any commercial purpose; m) harass, pester, send excessive emails to or otherwise indulge in hostile or unreasonable communications with any buyer, seller or other member through the BonsaiForum internal email facility; n) collect personal data about other users for commercial or unlawful purposes; o) use automated means, including spiders, robots, crawlers, data mining tools, or the like to download data from the BonsaiForum - unless expressly permitted by thee management; p) attempt to gain unauthorized access to BonsaiForum's computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the BonsaiForum website; or q) use any form of automated device or computer program that enables the submission of postings on Bonsaiforum without each posting being manually entered by the author; 7. NO SPAM POLICY You understand and agree that sending unsolicited email advertisements to BonsaiForum email addresses or through BonsaiForum's computer systems, is expressly prohibited by the T&C. Such violations may subject the sender and his or her agents to civil and criminal penalties. BonsaiForum reserves the absolute right to cancel the membership of any member found to be in violation of the T&C in this regard. 8. LIMITATIONS ON SERVICE You acknowledge that BonsaiForum may establish limits concerning use of its services, including the maximum number of days that content will be retained, the maximum number and size of postings, images, email messages, or other content that may be transmitted or stored by BonsaiForum. You agree that BonsaiForum has no responsibility or liability for the deletion or failure to store any content. You acknowledge that BonsaiForum reserves the right at any time to modify or discontinue its service (or any part thereof) with or without notice, and that BonsaiForum shall not be liable to you or to any third party for any modification, suspension or discontinuance of any service. 9. ACCESS TO THE SERVICE When you create an account, BonsaiForum grants you license to access its service for your own personal use. This license does not include: (a) access to the Service by Posting Agents; or (b) any collection, aggregation, copying, duplication, display or derivative use of the service nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by BonsaiForum. A limited exception to (b) is provided to general purpose internet search engines and non-commercial public archives that use such tools to gather information for the sole purpose of displaying hyperlinks to content of advertisements, provided they each do so from a stable IP address or range of IP addresses using an easily identifiable agent and comply with our robots.txt file. BonsaiForum permits you to display on your external website, or create a hyperlink on such website, to individual postings on the site. You may also create a hyperlink to the home page of BonsaiForum so long as the link does not portray BonsaiForum, its employees, or its affiliates in a false, misleading, derogatory, or otherwise offensive matter. 10. TERMINATION OF SERVICE You agree that BonsaiForum, in its sole discretion, has the right (but not the obligation) to delete or deactivate your account, block your email or IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any content within the Service, for any reason, including, without limitation, if BonsaiForum believes that you have acted inconsistently with the letter or spirit of the T&C. Further, you agree that BonsaiForum shall not be liable to you or any third-party for any termination of your access to its services. 11. PROPRIETARY RIGHTS All content on BonsaiForum is protected to the maximum extent permitted by copyright laws and international treaties. Content displayed on or through BonsaiForum is protected by copyright as a collective work and/or compilation, pursuant to copyrights laws, and international conventions. Any reproduction, modification, creation of derivative works from or redistribution of the site or the collective work, and/or copying or reproducing the sites or any portion thereof to any other server or location for further reproduction or redistribution is prohibited without the express written consent of BonsaiForum. You further agree not to reproduce, duplicate or copy content from this site without the express written consent of BonsaiForum, and agree to abide by any and all copyright notices displayed on any individual posting. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover any source code. Without limiting the foregoing, you agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any aspect of the BonsaiForum service. Although BonsaiForum does not claim ownership of content that its users post, by posting content to any public area of the BonsaiForum site, you automatically grant, and you represent and warrant that you have the right to grant, to BonsaiForum an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute said content for the purpose of promoting BonsaiForum and its services. 12. DISCLAIMER OF WARRANTIES You agree that use of the BonsaiForum site and services offered therein is entirely at your own risk. The BonsaiForum site and services are provided without any warranties of any kind. All express and implied warranties including, without limitation, warranties of merchantability, reliability, authenticity, fitness for a specific purpose and non-infringement of proprietary rights are expressly disclaimed to the fullest extent permitted by law. To the fullest extent permitted by law, BonsaiForum disclaims any warranties for the security, reliability, accuracy and performance of the BonsaiForum site and services. To the fullest extent permitted by law, BonsaiForum disclaims any warranties for other products or services received through or advertised on the BonsaiForum site or any service offered therein, or accessed through any links on the BonsaiForum site. To the fullest extent permitted by law BonsaiForum disclaims any warranties for viruses or other harmful components in connection with the BonsaiForum site or any of its services. 13. LIMITATIONS OF LIABILITY Under no circumstances shall BonsaiForum be liable for direct, indirect, incidental, special, consequential or exemplary damages (even if BonsaiForum has been previously advised of the possibility of such damages) resulting form any aspect of your use of BonsaiForum or its services, whether the damages arise from use or misuse of the BonsaiForum site or services or the interruption, suspension, modification or termination of the BonsaiForum site or any of its services. Such limitation shall also apply with respect to damages incurred by reason of other services or products received through or advertised on the bonsaiForum site or through any BonsaiForum service, or via any links on the BonsaiForum site, as well as by any reason of any information, advice or claims received through or advertised on the BonsaiForum site or any other site or source linked to on the BonsaiForum site. These limitations shall apply to the fullest extent permitted by law. 14. INDEMNITY You agree to indemnify and hold BonsaiForum, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of content you submit, post or make available through the services offered by BonsaiForum, your use of the services, your violation of the T&C, your breach of any of the representations and warranties herein, or your violation of any rights of another. 18. GENERAL INFORMATION The T&C constitute the entire agreement between you and BonsaiForum and govern your use of the service offered, superseding any prior agreements between you and BonsaiForum. The failure of BonsaiForum to exercise or enforce any right or provision of the T&C shall not constitute a waiver of such right or provision. If any provision of the T&C is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the T&C remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the BonsaiForum service or the T&C must be filed within one (1) year after such claim or cause of action arose or be forever barred.
